1. Introduction

These Terms of Service govern the use of the Pacco Planning platform. By registering or using our services, you agree to these terms.

2. Definitions

• Customer — The company or natural person that creates an account and uses the platform.
• Customer Content — All data, text, images, and other content the customer inputs into the platform.
• Subscription — Paid access to the platform under the selected plan.

4. Eligibility

Pacco is a B2B platform. Use is restricted to businesses and self-employed persons. By registering you confirm that you act on behalf of a business.

5. Account and Security

You are responsible for the security of your account. Keep your credentials confidential and notify us immediately of any unauthorized use. We are not liable for damages caused by unauthorized access to your account.

6. Subscriptions, Fees and Payments

Subscriptions are billed monthly. Prices exclude statutory VAT. Payments are processed via Stripe. In case of payment default, we reserve the right to restrict access to the platform.

7. Acceptable Use

You may only use the platform for lawful purposes. In particular, the following are prohibited: reverse engineering, automated scraping, injecting malware, using the platform to disadvantage other users, and any action that impairs platform operation.

8. Privacy

The protection of your data is important to us. For details on the processing of personal data, please refer to our Privacy Policy.

9. Confidentiality

Both parties undertake to keep confidential information of the other party confidential and not to disclose it to third parties unless required by law or necessary for contract performance.

10. Intellectual Property

All rights to the platform, including software, design, trademarks, and content, belong to Pacco Planning UG. The customer receives a non-exclusive, non-transferable right of use for the duration of the subscription. Customer Content remains the property of the customer.

11. Feedback

If you submit suggestions, ideas, or feedback about the platform, you grant us the right to use this feedback free of charge to improve our services.

12. Third-Party Services

The platform may include integrations with third-party services (e.g. Stripe). The respective terms of these third parties apply. We assume no liability for third-party services.

13. Beta Features

We may from time to time offer beta features that are labeled as such. Beta features are provided without warranty and may be modified or discontinued at any time.

14. Availability and Support

We strive for high platform availability but cannot guarantee uninterrupted use. Planned maintenance will be announced in advance. Support is provided via email during business hours.

15. Warranty Disclaimer

The platform is provided as-is. To the extent permitted by law, we disclaim all express or implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

16. Limitation of Liability

Our liability is limited to intent and gross negligence. For ordinary negligence, we are liable only for breaches of material contractual obligations. In these cases liability is limited to the foreseeable, contract-typical damage. Liability for damage to life, body, and health remains unaffected.

17. Indemnification

The customer shall indemnify Pacco Planning against all third-party claims arising from the customer's unlawful use of the platform or breach of these Terms.

18. Term and Termination

The contract is concluded for an indefinite period and can be terminated by either party at any time with effect to the end of the current billing period. We reserve the right to immediately suspend access in case of serious breaches. After termination, you may export your data within 30 days.

19. Governing Law and Venue

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Venue for all disputes arising from or in connection with these Terms is Berlin, Germany.

20. Changes

We reserve the right to update these Terms. For material changes, we will notify you at least 30 days in advance. Continued use of the platform after the changes take effect constitutes acceptance.
